Social Security Lawyers: SSDI’s Looming Problems and How to Fix It

Reallocating how Social Security tax money is spent involves taking money for retirement benefits and using it for disability benefits, and is a solution suggested by Treasury Secretary Jacob Lew. Despite the solution’s viability, it remains to be a temporary fix that’s bound to cause a whole host of problems in the future. Clearly, massive changes to the system are necessary to ensure SSDI benefits are disbursed in a fair, timely, and efficient manner. As social security lawyers know, the years claimants spend waiting for their benefits during the application process is suffering enough. Reduced benefits will only add to their suffering.

New Rules a Charleston Social Security Lawyer and his Client Must Know

Bigger payments – To keep up with inflation, social security payments are automatically adjusted every year. For 2015, concerned parties can expect a 1.7 percent cost-of-living adjustment, with a typical retiree slated to receive about $22 more per month. This adjustment will also increase the average monthly payout for retirees from $1,306 to $1,328. On the other hand, retired couples who receive benefits individually can expect to get $36 more on their average payouts. New 401(k) limit – For 2015, concerned parties can expect a $500 increase to the 401(k) contribution limit. Workers 50 years and older also face an increase to their catch-up contribution limits amounting to $500. One can also look to maximize a significant amount of tax deferral on such policy change—i.e. a beneficiary under 50 years of age who’s in the 25 percent tax bracket and shells a maximum contribution amount can save up to $4,500 on his/her federal income tax bill.

Social Security Disability Lawyer in Charlotte, NC’s Take on Illness

One of the things a person opting for SSDI should be aware of is that when filing an individual request, the condition being experienced by the claimant should be such that it renders him or her unable to function and earn a living. On that note, a professional social security lawyer in Charlotte, NC keeps in mind that when it comes to filing for Social Security benefits, a person’s disability or condition does not necessarily have to exactly satisfy any of the conditions listed in the Blue Book. Rather, the SSA determines whether the symptoms exhibited closely and medically resemble that of an existing disorder found on the list. Once this is confirmed, the patient is deemed eligible for benefits; this is called “equaling a disability listing.” Upon filing a claim, the claimant will have to present recent medical evidence to the SSA—such as a physical examination record, an MRI, X-rays, and mental health records—to determine the validity of the claim.

Hire a Huntington, WV Social Security Disability Lawyer for SSDI

Sally Greer was a professional educator and caretaker until her illnesses began taking their toll on her career. Her health started to decline in 2008 when she had difficulty breathing, and eventually developed pneumonia. No less than 40 doctors looked at her case but were unable to diagnose the source of her ailments. To make matters worse, Sally began having a hard time remembering things, and even walking. Tests were inconclusive, and the mystery behind her condition remained unsolved. After a long struggle with her ailments, she decided she could no longer work and applied for SSDI. Not surprisingly, her initial application was denied. This is a situation that isn’t isolated to applicants like Sally in California. It’s common among applicants in other states, including West Virginia and North Carolina.

A Parkersburg, WV Social Security Disability Lawyer Gives You a Chance

A common mistake of many people claiming Social Security disability benefits is that they go into the local field office or apply online with little to no preparation. If you really need your social security claim to be approved as quickly as possible, taking your time to learn the ins-and-outs of the claims process may not be the best choice. With a lawyer on your side, you’ll have several advantages. First, they can guide you in filling out your application so that it clearly shows to the Social Security Administration (SSA) that you meet one of their listed disabilities or that you are obviously not able to work.

Social Security Disability Eligibility and the ABLE Act—The Connection

With a vote of 404-17 on December 3, 2014, an overwhelming response since the legislation of the 1990 Americans with Disabilities Act, the House approved the legislation called the Achieving a Better Life Experience (ABLE) Act, which will benefit as many as 54 million disabled people and their families, especially those struggling to pay for intensive forms of care. The ABLE Act, introduced in 2006, lists 85 percent of Congress as co-sponsors and, on December 16, 2014 was voted by the U.S. Senate to become part of the Tax Extenders package. Finally, on December 19, the President of the United States signed the Tax Extenders package, thereby enforcing the ABLE Act. Under the ABLE Act, families would be able to set up tax-free bank accounts at financial institutions and deposit up to $14,000 annually to pay for long-term needs such as education and health care. These accounts could accrue by as much as $100,000 in savings.

Trustworthy Social Security Lawyers Clear Up Confusion on Benefits

A lot of information has been made available about Social Security benefits people can acquire once they reach the age of 65, but little is known about their disability benefits. One thing for certain about this is that the process of getting approval is quite a challenge because of strict qualifications, and you might need the help of a reliable Social Security lawyer to have a better chance of approval. Also, acquiring disability benefits will not only aid the disabled person, but also his immediate family, and once the person receiving benefits reaches the retirement age, he might start to worry about the financial support he is getting. However, you need not fear about no longer receiving disability benefits, for disabled people who are at the retirement age will automatically have their disability benefits converted to retirement benefits, and there will be no need to apply or to notify the Social Security Administration.
